The Website and App are online lending platforms for Users to avail the financial services. We are committed in protecting and respecting Your privacy.

This Privacy Policy is an electronic record in the form of an electronic contract formed under the Information Technology Act, 2000 (“IT Act”) and the rules made thereunder. This Privacy Policy does not require any physical, electronic, or digital signature. This Privacy Policy is a legally binding document between You and Us. The terms of this Privacy Policy will be effective upon your acceptance of the same, by clicking on the “I Accept” checkbox available at www.guardiansecuritiespltd.com(“Website”) and will govern the relationship between You and Us for Your use of the Website and/or App (as the case may be). By clicking on the “I Accept” checkbox, You also authorize Us to contact You if You are registered with DND/NDNC registry.

For the purposes of this Privacy Policy, the terms “Personal Information” and “Sensitive Personal Data and Information” shall have the meanings ascribed to them under the Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011 (“SPDI Rules”) and shall hereby be deemed to be included in this Privacy Policy by reference.

This Privacy Policy is prepared in compliance with the IT Act, the SPDI Rules, the Guidelines on Digital Lending, 2022 (“Digital Lending Guidelines”) issued by the Reserve Bank of India (“RBI”), frequently asked questions on the Digital Lending Guidelines, and all other applicable acts, regulations, and rules which require the publishing of a privacy policy for handling of or dealing in Personal Information, including Sensitive Personal Data and Information and all other applicable laws, regulations and guidelines provided by the applicable regulatory authorities, including but not limited to the RBI.

1.What is the information collected by Us and why do We need to collect such information

To avail the Services (as defined in the Terms of Use), including to make use of certain features on the Website and/or the App, You voluntarily provide Us certain Personal Information and/or Sensitive Personal Data and Information, whether as a visitor, contributor, subscriber, sponsored service user or customer (“User(s)”, “You”, or “Your”).

You acknowledge that We shall collect the information detailed under this Privacy Policy to facilitate lending services by partnering with various financial lenders, agents and third-party service providers based on Your requirement to avail such Services.

The Website and/or the App (as the case may be) shall also collect Your Personal Information and/or Sensitive Personal Information and Information in order to enable You to avail the Services.

YOU MAY, AT YOUR DISCRETION REQUIRE US TO STOP COLLECTING, STORING, TRANSFERRING AND/OR PROCESSING YOUR PERSONAL INFORMATION AND/OR SENSITIVE PERSONAL DATA AND INFORMATION. IN SUCH AN INSTANCE, WE WILL NOT BE ABLE TO PROVIDE THE SERVICES TO YOU AND YOU WILL BE STOPPED FROM AVAILING OUR SERVICES.

PLEASE NOTE THAT WE ONLY COLLECT, STORE, TRANSFER AND/OR PROCESS SUCH PERSONAL INFORMATION AND/OR SENSITIVE PERSONAL DATA AND INFORMATION AS IS NECESSARY FOR US TO PROVIDE YOU WITH THE SERVICES. WE DO NOT COLLECT, STORE, TRANSFER AND/OR PROCESS ANY PERSONAL INFORMATION AND/OR SENSITIVE PERSONAL DATA AND INFORMATION WHICH IS NOT NECESSARY FOR US TO PROVIDE YOU WITH THE SERVICES.

Your Personal Information and/ or Sensitive Personal Data and Information also helps Us enhance Our Services that We offer to You, by allowing Us to tailor Our Website and/or the App to cater to Your personal interests and make them more useful to You. Further, Your information is required to create and maintain Your accounts with Us and to contact You in case You need support. As a User, You hereby voluntarily agree and give us Your consent that Your Personal Information and/ or Sensitive Personal Data and Information may be collected, used and handled by Us as detailed in this Privacy Policy.

We may ask for and collect the following information about You when You use the Website and/or the App and without such information, We may not be able to provide You with all the requested Services:

Registration / Sign-up Data
To use certain features on the Website and/or the App, You are required to provide basic personal information, including but not limited to the following:
(a) name;
(b) mobile number;
(c) e-mail address;
(d) date of birth;
(e) residential address;
(f) identity proof;
(g) address proof;
(h) permanent account number;
(i) aadhaar card details;
(j) financial information such as monthly salary (pay slips), income tax returns, name of the bank which hosts the primary account, bank account number, bank statements and credit information;
(k) employment related details, such as name of the current employer, office address and details regarding the time period completed with the current employer;
(l) details of family members; and
(m) any other information that We are required to collect as per the specific mandate from RBI or as a requirement under applicable law in India.
We may further collect and record the following Personal Information/Sensitive Personal Data and Information under the “my profile” section, which helps Us to provide customized feeds, complete mandatory know your customer (“KYC”) and maintain a User profile, including but not limited to:
(a) Your social media details like Your user name, while You are registering through social media accounts or e-mail accounts;
(b) Your internet protocol (“IP”) address, redirecting URLs, cookie identifiers, Your IMEI (International Mobile Equipment Identity) and Your device geo location. We collect device details and IP solely for Our internal data security purposes;
(c) data or information provided by You by filling forms or questionnaires on the Website and/ or App;
(d) any document, image or video that may be relevant for providing You with the Services; and
(e) any other information that may be relevant for providing You with the Services as and when required.
Mobile Device Permissions: When accessing the App on mobile device/ tablet/ TV or any other device having access to the App, We may request and gain access to the following:
(a) Contacts – used for accessing Users contact in order to share articles through the App;
(b) Phone – to enable User notifications on User’s device, IMEI (International Mobile Equipment Identity) number is being collected to uniquely identify every User;
(c) Camera – in order for the User to upload images and profile image of the User;
(d) Microphone – to enable voice command related actions;
(e) Storage – to access files and folders from inside the App; and
(f) SMS / WhatsApp messaging – to send and receive verification messages/ one-time passwords (OTP).
Permissions to these settings may be essential for adequate running of the App. Such permissions can be managed through the respective User devices using the ‘settings’ option.
By using and/or registering on the Website and/or the App, You authorize Us (including Our representatives, affiliates, and business partners) to contact You via e-mail or phone call or SMS and offer You the Services that You have opted, imparting knowledge on products/ Services, offer promotional offers running on the Website and/or the App and offers by Our business partners and associated third parties, for which reasons Your information may be collected in the manner as detailed under this Privacy Policy. You hereby agree that You authorize Us to contact You for the above-mentioned purposes even if You have registered yourself under DND or DNC or NCPR service(s). Your authorization, in this regard, shall be valid as long as Your account is not deactivated by either You or Us.
We shall collect additional Personal Information and/or Sensitive Personal Data and Information like:
(a) information pertaining to the loans procured from other commercial banks, primary/ state/ district/ central co-operative banks, non-banking financial companies (including housing finance companies) (“Regulated Entities”) by the User, in any physical, digital or electronic form;
(b) information obtained through the online tool or calculators available on the Website and/or the App or while availing Our Services online;
(c) credit related information, such as credit report which is collected from credit information bureaus;
(d) information derived by way of any transaction initiated by a User on the Website and/or the App or any other payment gateway links available on the Website and/or the App; and
(e) information received by Us through third parties such as employers, professionals or banks etc., for securing the benefits and Services provided by Us.
We will neither collect nor store any biometric data in Our systems.
Information You provide Us voluntarily: If You send Us personal correspondence, such as e-mails or letters, or if other Users or third parties send Us correspondence about Your activities or postings on the Website and/or the App, We may collect and store such information. We may also collect additional information at other times, for example, when You provide feedback(s), modify Your content or e-mail preferences, respond to surveys, or communicate with Us. This information may include Your name, e-mail address, mobile number and location.
Information We collect automatically: We collect information about You and Your use of Our Services, Your interactions with Us as well as information regarding Your devices used to access Our Services (such as mobile devices, tablets and other viewing devices).
This information includes but is not limited to:
(a) activities on the Website and/or the App, such as type of pages viewed, time spent on pages, search queries etc;

The only Personal Information / Sensitive Personal Data or Information which a cookie can hold is the information You supply. A cookie cannot read data from Your hard drive. We may use various tools like chart tools and tracking tools on the Website and/or the App to improve the customer experience by showing or advertising such goods/Services We think may be of interest to You. We use non-persistent cookies for managing the users’ logged-in session and persistent cookies for managing the performance.

We use such data to tailor Your experience on the Website and/or the App, providing You with content that We think You might be interested in and to display content according to Your preferences.
Information We collect through third parties: When You register with Us using Your other accounts, i.e., Google, Facebook, etc., We retrieve information from such accounts to continue to interact with You and to continue providing the Services. We collect the following information from the respective social media platforms, including but not limited to public information, name, and e-mail address.

2.PAYMENT INFORMATION

We do not collect any payment information from the Users. Instead, Users, whenever required to make any payment to Us, are simply directed to go to a third party / bank website to make a transaction and hence the privacy policies for such third party/ bank will be applicable for making any payment to Us.

3.USES OF INFORMATION COLLECTED

We use all the information provided by You only for the legitimate scope of Services offered to You through the Website and/or the App. Further, We use Your information:

for Your login purpose, to communicate with Our partners/ third parties that may be required for making credit decisions and extending the Services under scope;
to show You the most relevant content based on Your interest for an improved experience;
to contact You if the products or Services You have requested are not available;
to help investigate violations of Our terms of use or to defend against legal claims;
to search credit bureaus, generate credit reports, and for fraud screening and prevention purposes;
to respond to Your questions or comments;
to suggest other people having similar interests like You;
to analyse and understand Our audience, improve Our Services (including Our user interface experiences), optimize content selection, and recommendation algorithms;
to trace Your whereabouts for the purpose of on-boarding / KYC requirements;
to carry out process review and audits under the regulatory framework;
to conduct analysis and research to improve the Website and/or the App;
to avail identity verification services;
to personalize and enhance Your experience on Our Website and/ or App, as well as to enable You to use the features of these platforms;

We may accept or reject the data and documents provided by You in case it breaches Our system’s security policies and if it attracts any malware or viral threat to Our software application or server.

However, any Personal Information provided by You will not be considered as sensitive if it is freely available and/or accessible in the public domain, like any comments, messages, blog posts, or scribbles available on social media platforms like Facebook and Twitter. Any information posted/ uploaded/ conveyed/ communicated by Users on the public sections of the Website and/or the App becomes published content and is not considered personally identifiable information subject to this Privacy Policy.

In case You choose to decline to submit personally identifiable information, We may not be able to provide certain Services to You. In any case, We will not be liable and/or responsible for Our denial of certain Services to You for lack of You providing the necessary Personal Information. When You register on the Website and/or the App, We shall contact You from time to time about updating Your Personal Information to provide the Users with such features that We believe may benefit/interest You.

4.SECURITY

We know how You care about the privacy and the security of Your Personal Information, which is why We are committed to respect and protect Your privacy and Your information shared with Us, from any unauthorised access or loss. All information gathered on the Website and/or the App is securely stored within Our controlled database. The database is stored on servers, which are located within the boundaries of India. The servers are secured behind a firewall and access to these servers is password protected and strictly limited. If You know or have any reason to believe that Your account credentials have been lost, stolen, altered, or otherwise compromised, or in case of any actual or suspected unauthorized use of Your account, please contact Us via e-mail.
However, be aware that in this age of digital disruption, the transmission of information via the internet is never completely impenetrable. Hence, Users should also take requisite steps to protect their Personal Information against any unauthorised access. Such steps include choosing a strong password, signing off after using a shared device, and keeping Your log-in details, especially Your password(s) private. We shall not be held responsible for any lost, stolen, or compromised information or for any activity on Your account via unauthorised password usage.
In the event of any security breach, We implement the following prescribed standards to handle the same:
(a) all suspected or reported security breaches or violations are logged and tracked from initiation of the preliminary analysis till the completion of actions taken in order to determine whether there was a security breach or violation;
(b) in order to be able to effectively escalate incidents to relevant authorities, their appropriate contacts are maintained, including but not limited to the local cyber cell;
(c) when a breach of security occurs, the following steps are immediately undertaken:
(i) quick action to secure the systems and fix vulnerabilities that may have caused the breach;
(ii) for preventing additional loss of data, the servers are switched off and the access code is changed;
(iii) a breach response team is mobilized immediately to prevent additional loss of data;
(iv) additional security is placed, as required; and
(v) personally identifiable information and other sensitive data is deleted when it is no longer required for business purposes;
(d) as soon as there is a breach of security, We will notify You electronically so that appropriate steps can be taken by You as well;
(e) in accordance with the Indian Computer Emergency Response Team (“CERT-In”) cyber-security directions under section 70B (6) of the IT Act (“CERT Directions”), We shall report cyber incidents (as mentioned in Annexure I of the CERT Directions) within 6 (six) hours of noticing such incidents or being brought to notice about such incidents. For incidents not covered herein, We shall report cyber security incidents within a reasonable time of occurrence or noticing the incident to have scope for timely action under Rule 12(1)(a) of the IT (The Indian Computer Emergency Response Team and Manner of Performing Functions and Duties) Rules, 2013 to CERT-In via email at (incident@cert- in.org.in), phone (1800-11-4949) and fax (1800-116969). We shall comply with the IT Act and the SPDI Rules with respect to the applicable cyber security standards.
You are required to follow the below mentioned guidelines while using the Website and/or the App:
(a) don’t break Our security measures or test the vulnerability of Our systems or networks;
(b) don’t access or use the Website and/or the App by means of any mechanism or technology which conceals Your actual geo-location or provides incorrect details of Your location (for example, use a virtual private network (VPN) to access the Services);
(c) don’t try to interfere with Our networks, like sending a virus, overloading, spamming;
(d) don’t collect or store personally identifiable information of people on the Website and/or the App;
(e) don’t provide any unauthorized personal information of third parties while providing or contributing any User generated content on the Website and/or the App;
(f) don’t share Your password(s), allow anyone to access Your account or do anything that might put Your account at risk;
(g) don’t attempt to buy or sell access to Your account, or usernames, or otherwise transfer account features for compensation;
(h) don’t create or operate accounts that aren’t authentic;
(i) don’t create new accounts for the purpose of violating these guidelines;
(j) don’t link Your web browser to website(s) that are unsafe, deceptive, untrustworthy, unoriginal, or that facilitate or encourage spam; and
(k) don’t send unsolicited messages or make irrelevant comments on the content of the Website and/or the App.

5.YOUR CONTROLS AND CHOICES

Rectification of Inaccurate or Incomplete Information:

YOU ARE REQUIRED TO IMMEDIATELY INFORM US OF ANY CHANGE OR INACCURACY OR INCOMPLETENESS OF YOUR INFORMATION PROVIDED TO / AVAILABLE WITH US.

You may ask Us to correct inaccurate or incomplete Personal Information concerning You (this is the information that You cannot update Yourself within Your account) by sending Us an e-mail. You can access and update some of Your Personal Information through Your account settings Yourself as well. If You have chosen to connect Your profile to a third-party application, like Facebook or Google, You can change Your settings and remove permissions for the Website and/or the App by changing Your account settings. You are responsible for keeping Your Personal Information up-to-date. We may send You periodic reminders via e-mail to maintain the accuracy of Your Personal Information.

Data Retention and Erasure: We retain Your Personal Information as long as necessary for Our legitimate business interests in order to provide the Services to You and for Us to comply with Our legal obligations. We keep Your information in Our records till the time it serves the purpose of Our Services or as long as necessary based on the statutory requirements. If You no longer want Us to use Your information, then You can request that We erase Your Personal Information and close Your account. Please note that if You request for the erasure of Your personal information, We may:
(a) still retain some of Your Personal Information and/ or Sensitive Personal Data or Information as necessary for Our legitimate business interests, such as fraud detection, prevention and enhancing safety. For example, if We suspend an account for fraud or safety reasons, We may retain certain information from that account to prevent that User from opening a new account in the future.
(b) still retain and use Your Personal Information and/ or Sensitive Personal Data or Information to the extent necessary to comply with Our legal obligations under the applicable law. For example, We may keep some of Your information for tax purposes, legal reporting and auditing obligations.

Information that You have shared with others (e.g., reviews, forum postings) may continue to be publicly visible on the Website and/or the App, even after Your account is cancelled. However, attribution of such information to You will be removed. Additionally, some copies of Your information (e.g., log records) may remain in Our database, but are disassociated from personal identifiers. As We maintain copies of personal information to protect from accidental or malicious loss and destruction and hence, residual copies of Your Personal Information and/ or Sensitive Personal Data or Information may not be removed from Our backup systems for a limited period of time.

Withdrawing Consent and Restriction of Processing: For withdrawing Your consent at any time during the tenure of Your Services with Us, You may choose to do so by sending Us an e-mail. We shall review Your request and may ask You to verify Your identity. Post verification, We will withdraw the consent for which the request was made by You and stop any further processing of Your Personal Information.
Objection to Processing: Where Your Personal Information is processed for direct marketing purposes, You may, at any point of time ask Us to cease processing Your data for these direct marketing purposes by sending an e-mail to Us. Please be aware that if You do not allow Us to collect Personal Information from You, We may not be able to deliver certain experiences, products, and Services to You, and some of Our Services may not be able to take account of Your interests and preferences. If collection of personal information is mandatory, We will make that clear at the point of collection so that You can make an informed decision whether to participate or not. If You have questions about the specific Personal Information about You that We process or retain, and Your rights regarding that Personal Information, please contact Us via e-mail.
If You Fail to Provide Consent: The Website and/or the App are not an advertisement free platforms. Therefore, permissions to use and process Your Personal Information to provide advertisements is essential for Us to provide the Services to You. Use of personal information for advertisement is a binding criterion and We will not be able to provide You with Our Services if You fail to authorise Us to use Your Personal Information for the purpose of advertisement and the activities related to it.
Opting out of outreach from Us: If You have an account or a subscription with Us, We may send periodic recommendations or informational e-mails to You. You may opt-out of such communications by following the opt-out instructions contained in the said e-mails or by contacting Us via e-mail.

6.ACCESS TO YOUR GMAIL ACCOUNT

Where You allow Us to fetch Your bank statements from Your Gmail account, We will access your Gmail account by using [insert software details] API in the App or Website and extract your bank statements of past 6 (six) months for the purpose of determining your loan eligibility. No other information or emails from your Gmail account will be read, opened, accessed or viewed. All such bank statements extracted by Us shall be kept in Our records till such time as maybe required for loan assessment and for adhering with rules /regulations of RBI and other applicable law.

7.COLLECTION OF FINANCIAL SMS INFORMATION

Our App collects and monitors only financial SMS sent by alphanumeric senders from Your inbox which helps Us in identifying the various bank accounts that You may be holding, cash flow patterns, description, and amount of the transactions undertaken by You as a user to help Us perform a credit risk assessment which enables Us to determine Your risk profile and to provide You with the appropriate credit analysis and offers. This financial SMS data also includes Your historical data. While using the App, it periodically sends the financial SMS information to Us.

8.COLLECTION OF INFORMATION FOR LOAN ASSESSMENT

As a part of Our App loan assessment, We require references from the loan applicant(s). In this regard, during filing the form on Our App, We collect and monitor Your information such as contact information, which includes name, phone number, account type, contact last modified, favourites and other optional data, like relationship and structural address to enable You to autofill the data during the loan application process. This information is required for the purposes of risk analysis, enabling Us to detect credible references, assess Your risk profile and to determine Your loan eligibility.

9.THIRD PARTY WEBSITES

You may be able to access third party websites directly from Our Website and/or the App. With this Privacy Policy, we are only addressing the disclosure and use of data collected by Us. If You visit any other websites through the links on the Website and/or the App, you should properly review the privacy policies of each of those websites. Their data collection practices and their policies might be different from Ours and We do not have control over any of their policies. WE DISCLAIM ALL RESPONSIBILITY OR LIABILITY WITH RESPECT TO THESE POLICIES OR THE WEBSITES.

10.REFERRALS

If You choose to provide a few referrals to introduce Us to any other person/ entity, We may ask You to provide such person/ entity’s name, email address and phone number, provided You have obtained explicit consent for disclosing such Personal Information about the person / entity You refer to Us. We will automatically send such person/ entity an email inviting it or to visit the Website and/ or the App. We store this information for the purpose of sending this email and keeping a record of the number of persons / entities so referred by You and We may send additional emails to the said person / entity in connection with the Services offered by Us.

Such person/entity may contact Us at [email protected] to request that this information be removed from Our database.

11.TESTIMONIALS

We may display personal testimonials of satisfied customers on our Website / App in addition to other endorsements. With Your consent, we may post Your testimonial along with Your name.

12.POLICY ON MINOR’S INFORMATION

We do not seek or intend to seek or receive any personal information from children. Hence, children, i.e., persons under the age of 18 (eighteen) years are not allowed to register on the Website and/or the App. If We become aware that any personally identifiable information of children has been collected on the Website and/or the App without verified parental consent, then We will take the appropriate steps to delete any such information and notify the concerned parent/ guardian. However, We consider it the responsibility of parents / guardians to monitor their children’s use of Our Services.
